Claims

Overview of the types of claims that may be covered, limitations, exclusions and how to submit a claim.

 

Covered Loss

A "Covered Loss" is defined as accidental community property damage arising from fire, smoke, explosion, water discharge or sewer backup caused by the participating resident’s sole negligent act(s) or omission(s) occurring during a time in which such resident is enrolled in the RiskRelease program. 

“Covered Cause of Loss” means any of the following causes of loss provided that it causes property damage to the Covered Premises of an Enrolled Resident within the  Enrollment Period, while arising out of the solely negligent acts or omissions of an Enrolled Resident:

  • Fire.
  • ExplosionThis cause of loss does not include loss or damage by:
    • Rupture, bursting or operation of pressure relief devices; or
    • Rupture or bursting due to expansion or swelling of the contents of any building or structure, caused by or resulting from water.
    • Underground or internal building components secured, or a part of, wires, conduits, pipes, mains, sewers, tanks, tunnels, or any similar property, and any apparatus used with them that exists beneath the surface of the ground or water
  • Smoke. This cause of loss does not include:
    • Smoke from agricultural smudging, industrial operations, tobacco, or other personal inhalants. 
  • Water that backs up or overflows from a sewer, drain, or sump.
  • Water or other liquid which leaks, flows or overflows from plumbing, heating, air conditioning or other equipment or fixtures.

"Covered Premises” means the leased premises of an Enrolled Resident.

RiskRelease will pay up to the liability amount listed in the lease agreement for the property damages for which the Enrolled Resident is liable. The Enrolled Resident shall be responsible for any cost of damages in excess of this amount.

Uncovered Loss

Excluded from coverage are the following: 

  • Claims of
    • Personal injury or bodily injury;
    • Lost or damaged personal property
    • Loss of use of the property
    • Property damage to carpeting or flooring due to Pet Damage;
  • Damage resulting from, or associated with,
    • breach of the lease
    • intentional or malicious acts
    • business pursuits
  • Damage arising out of the ownership, maintenance, use, loading or unloading of:
    • an aircraft;
    • a motor or self-propelled vehicle;
    • mobile equipment;
    • a watercraft
  • Damage caused by
    • war, military action, rebellion, or government response to these events
    • earth movement of any kind
    • water, meaning:
      • Flood, surface water, waves, tides, overflow of any body of water, or spray from any of these, all whether or not driven by wind;
      • Water under the ground surface pressing on, or flowing or seeping through:
        • Foundations, walls, floors, or paved surfaces;
        • Basements, whether or not paved;
        • Doors, windows, or other openings;
      • Water from frozen or broken pipes due to changes in temperature.
  • Arising out of:
    • Mold, fungus, wet rot, dry rot, or bacteria 
    • Bursting, freezing or rupturing of water pipes;
    • Leakage or discharge of water or steam from any part of a system or appliance containing water or steam.
    • Explosion of steam boilers or machinery, steam pipes, steam engines or steam turbines;
    • Terrorism. "Terrorism" means activities against persons, organizations or property of any nature

    Claims Submission Process

    If you accidentally cause damage to the community, it may be covered under the RiskRelease program. If this occurs, your property manager must report the incident to RiskRelease within 10 days of when it occurs. 

    To complete the submission your property manager may ask you for details about the incident, including:

      • A description of what happened, including the date and time
      • The type of damage that occurred
      • Any photos or documentation

    Once the incident has been submitted, RiskRelease will review it within 48 hours and provide your property manager with next steps.

    As a reminder, the RiskRelease program applies only to certain types of accidental damage caused by resident negligence.
